Pedro and Keith

Most of you probably know this already: http://oink.cd/index2.html

Please do not interpret too much into this. Nobody can say who those two people are. My personal guess would be that Pedro is probably someone in the police department, who is halfway capable of creating a website. And Keith is some sort of investigator? As said, nobody can say for sure. Try not to involve yourselves in unnecessary speculations in this matter, which only leads to more panic among the users. Thank you.

There is no reason to believe that Pedro was some sort of undercover person,
and that he is the one responsible for getting the site shutdown.

In case the index2.html has been removed by now, here is a screenshot.

My guess is the email was recieved in Microsoft Outlook, he hit reply, then save as web page. And found himself in the grassy knoll. On an island with special healing properties.

I still find it rather curious that the IPFI is allowed to just "hijack" the domain and use it for their own purposes, that just seems utterly wrong. I am also not quite sure why the ISP is playing along on this one, sure they lost their server, but why do they post the notice? There is no legal requirement, much less while there is police involvement.

Strange really.

I doubt the hosting provider put that notice there, it was more likely a mistake by the authorities.

The servers were confiscated and taken away by the authorities to be "analyzed", so you can assume that the physical server doesn't reside at that address anymore.

Furthermore, the authorities would probably not put an IPFI logo up there, if anything it would be an official seal.

Nope, that's part of the way of trying to intimidate all former OiNKers and pretty much anybody else who heard about this evil file sharing thing.

I so hope it'll blow up in IPFIs face and maybe even have OiNK himself go after them for all the false accusations.

It's curious how the original pink heart favicon.ico was left there for awhile (it's gone now).

Why would they copy this over from the old server?

I get that, but why would the authorities care? They have no "hand" in announcing their intentions, if you investigate a crime you do this in quiet until you have all the facts they have nothing to gain by "warning" the users that they are about to go after them. The only one gaining is IPFI etc. who want to scare people to stop doing this darn Torrent thing.

Either way, hoping the best for OiNK and once the thing gets thrown out I hope he goes after IFPI etc. I hate bullies.

Isn't the domain still owned by Oink? They shouldn't be allowed to just hijack it. And why would the ISP go along with it? They have no obligation to host that threatening message. This is BS.

Once this all blows over, you guys should sue them for stealing your webpage.

I have personally been encouraging other oink users I know to put the opplove smilie in their sigs everywhere they visit online just as a little show of solidarity :)

my question to all those that are commenting on taking action for suing the authorities who hijacked the page. If i'm not mistaken the FBI posted something like this on ET. What's the difference between wht happened on ET and on Oink? (in terms of warning messages)

Last I checked, cops don't do meth when busting a drug dealer...

Mediadefender probably has a clause in their contract that gives them "distribution" rights, unless they are completely retarded.

Well, MediaDefender e-mails also showed that they wanted their accounts to get a good ratio on oink and appear to be normal, participating accounts. I doubt they could get a good ratio without doing something illegal...

Well, it can't really be entrapment. Entrapment requires that you induce someone to criminal activity. The logical argument for OiNK is that there is no criminal activity involved. And technically there's not. Of course, will a judge see it that way? In every jurisdiction in which they might prosecute or file suit? This area of law is really quite unevolved, at least in the U.S. I imagine the UK isn't far ahead, though probably a bit. Torrents present a unique legal problem, as we're all aware. Frankly, they simply give lie to the fallacy that "intellectual property" is "property" at all. One cannot "own" information in the conventional sense, merely own some artificially created privilege which only has as much value as one can enforce. Of course, torrents may finally push the big boys into exerting increasingly overt extortion. On the other side, a friend of mine who's a Viacom exec. is working on a project to utilize file sharing to their benefit. The theory is that by encouraging filesharing they can use more subtle methods of advertising to generate hit-based ad revenue. Give the music away, and sell product placement in the video. Put a "Coke" logo in the bottom corner of a "leaked" TV show, etc. Invert the old revenue models and filesharing and big biz can coexist just fine.

Disclaimer: I know nothing about filesharing, BT, or OiNK. Never used it, just love telecom law, love it love it love it.
